1. Definitions & Applicability

1.1 Definitions

In these terms and conditions, the following terms are defined as:

Expedition Kilimanjaro: The trading name of Ramon Stoppelenburg Enterprises Ltd., established and registered in Tanzania, hereinafter referred to as "the organization" or "we".

Participant: The natural person who makes a reservation or on whose behalf a reservation is made for participation in an expedition.

Expedition: The service offered by the organization consisting of hotel accommodation and guided climb of Kilimanjaro (5,895m) including all associated facilities, guides, porters, catering and logistics.

Reservation: The application for participation in an expedition via the online reservation form.

Confirmed Booking: The confirmed participation after full payment of the expedition fee.

Lead Guide: The certified mountain guide appointed by the organization who is responsible for the execution and safety during the expedition.

Local Operator: The Tanzanian tour operator with whom the organization collaborates for the execution of the expedition.

1.2 Applicability

These terms and conditions apply to all agreements between Expedition Kilimanjaro and the participant. By submitting a reservation, the participant declares agreement with these terms.

1.3 Applicable Law & Competent Court

Tanzanian law applies to this agreement. Disputes will be submitted to the High Court Arusha Registry in Tanzania. This provision does not affect the mandatory consumer protection rules of the participant's country of origin insofar as they are more favorable to the participant.

1.4 Language Versions

This English version of the terms and conditions is authoritative. In case of differences between translations, the English text prevails.

2. Formation of Agreement & Reservation

2.1 Reservation Process

A reservation is established by complete and correct completion of the online reservation form on www.expeditionkilimanjaro.com (or equivalent country-specific websites).

2.2 Mandatory Information for Reservation

The following information is mandatory for a valid reservation:

2.3 Confirmation & Invoice

After receipt of a complete reservation, the participant will receive a confirmation and invoice by email within two working days.

2.4 Incomplete Reservation

Without the mandatory insurance information (article 4.1), no reservation can be realized. The reservation will only be processed once all mandatory information has been provided.

2.5 Confirmed Booking

A reservation only becomes a confirmed booking after receipt of full payment. After payment, the participant receives the final booking confirmation and vouchers. From that moment, hotel reservations are made and guides, porters and chefs are reserved for the mountain team.

2.6 Accuracy of Information

The participant is fully responsible for providing all information correctly and completely. Incorrect or incomplete information may lead to cancellation in accordance with article 10.6.

3. Payment & Administration Costs

3.1 Rates

All prices are stated per person in US dollars (USD) and exclude visas, vaccinations, personal insurance and personal expenses, unless expressly stated otherwise.

3.2 Payment Term

Full payment of the expedition fee must be made no later than 90 days before the start of the expedition. For reservations made within 90 days before departure, payment must be made as soon as possible, but no later than 7 days after receipt of the invoice.

3.3 Delay in Payment

Delay in payment may result in participation not being guaranteed due to limited availability of permits, accommodation and personnel. If participation is not possible due to late payment, full restitution of the payment will follow with deduction of USD 35 administration costs.

3.4 Administration Costs

USD 35 administration costs are charged per reservation.

3.5 Obvious Errors

Obvious errors in prices or programs can be corrected at any time. The participant will be informed immediately and has the right to cancel the reservation free of charge if the price increase exceeds 20%.

4. Mandatory Travel Insurance

4.1 Insurance Obligation

Participation in Expedition Kilimanjaro is only possible with valid and adequate travel insurance. Providing insurance information and policy number is mandatory when submitting the reservation.

4.2 Minimum Coverage

The travel insurance must provide at least the following coverage:

4.3 No Booking Without Insurance

Without valid insurance information, no reservation will be processed and no confirmed booking can be realized.

4.4 Verification

The organization reserves the right to request proof of insurance at any time. The participant is obliged to provide this within 48 hours.

4.5 Participant's Own Risk

All medical costs, evacuations, repatriations and Search & Rescue operations are at the expense and risk of the participant and must be covered by their own travel insurance. Expedition Kilimanjaro is not liable for this and will not advance costs.

4.6 Local Operator Evacuation Insurance

The local operator has insurance for Flying Doctors evacuations. This insurance only covers the costs of the evacuation flight itself. All other medical costs, treatments, hospitalization and repatriation are at the participant's expense.

5. Medical Declaration & Fitness

5.1 Medical Disclosure

The participant is obliged to report all medical conditions, physical limitations and relevant health information that may affect the climb when making a reservation, including but not limited to:

By participating, the participant declares to be physically and mentally capable of completing the expedition and has adequately prepared for the physical and mental challenges of a high-altitude expedition up to 5,895 meters.

Dietary requirements and allergies must be reported when making a reservation so that they can be communicated to the catering on the mountain. Expedition Kilimanjaro cannot guarantee the availability of specific foods and is not liable for allergic reactions.

6. Participation of Minors

6.1 Minimum Age

The minimum age for participation in Expedition Kilimanjaro is 14 years.

7. Execution of the Expedition

7.1 Program & Route

The daily programs provide the most realistic picture possible of the planned course, but local conditions such as weather conditions, trail conditions, accommodation availability or equipment failure may affect the exact execution.

7.2 Authority to Modify

The organization reserves the right to make changes to the route, daily program, accommodations, transport or excursions if circumstances require this. The goal is to guarantee the quality and character of the expedition at all times.

7.3 Alternative Accommodation

If accommodation is unexpectedly unavailable, an equivalent replacement will be provided.

7.4 Authority of Lead Guide

The lead guide has final responsibility for the safety and execution of the expedition at all times. His decisions regarding route, pace, safety and (premature) termination of the climb for individual participants or the entire group are binding and irrevocable.

7.5 Additional Costs Force Majeure

Additional costs arising from force majeure (see article 8) may be at the participant's expense.

7.6 Communication

Emergency contact is available 24/7 via the local operator in Arusha through the lead guide during the climb. Communication with the organization can take place via SMS, WhatsApp, Telegram and email. On the mountain itself, communication is limited to available network capacity.

8. Changes & Force Majeure

8.1 Force Majeure

Force majeure means: all circumstances beyond the organization's sphere of influence that make (temporary) fulfillment of the agreement impossible, including but not limited to:

In case of force majeure, the organization is entitled to cancel, modify or suspend the expedition without being liable for damages. The participant will be informed as soon as possible.

8.4 Changes on Initiative of the Organization

If the organization makes changes for reasons other than force majeure that substantially change the character of the expedition, the participant will be informed as soon as possible. The organization strives to maintain the original character and quality as much as possible.

9. Cancellation by Participant

9.1 Written Cancellation

Cancellation by the participant must be done in writing (by email). The cancellation date is the date on which the organization receives the cancellation.

9.2 Cancellation Costs

In case of cancellation by the participant, the following costs apply:

Taking out cancellation insurance is strongly recommended. Cancellation costs are not recoverable from the organization.

9.4 Rebooking or Postponement

The participant has no right to postponement to another date or rebooking of the reservation but can submit a request for this to the organization. In case of cancellation, the percentages as stated in article 9.2 apply.

9.5 Costs Already Paid

Cancellation costs cover costs already paid and non-recoverable such as permits, reserved teams and their wages, and accommodation reservations. These costs cannot be refunded.

10. Cancellation & Termination by Expedition Kilimanjaro

10.1 General Right to Cancellation

Expedition Kilimanjaro reserves the right to cancel, modify or terminate an expedition in whole or in part if this is deemed necessary due to:

The participant must follow the instructions of the guides at all times and behave respectfully towards staff, fellow participants and the local population.

10.4 Concealment or Incorrect Information

If the participant appears to have concealed relevant medical information during the expedition (article 5.3), immediate exclusion follows in accordance with article 10.2.

11. Code of Conduct & Safety

11.1 Following Instructions

Participants are obliged to follow the instructions of the lead guide and assistant guides at all times. This concerns instructions about:

11.2 Group Discipline

The expedition is carried out as a group activity. Participants must take into account the pace and capacities of the entire group and may not deviate from the group on their own initiative.

11.3 Alcohol, Drugs & Medication

The use of alcohol and drugs during the expedition is not allowed and leads to immediate exclusion in accordance with article 10.3. Medication use must be reported in advance (article 5.1).

11.4 Environment & Respect

Participants must adhere to Leave No Trace principles and the rules of Kilimanjaro National Park. Disrespectful behavior towards nature, culture or local population will not be tolerated.

11.5 Risk Acceptance

By participating in the expedition, the participant acknowledges and accepts the inherent risks of high-altitude activities, including but not limited to:

12. Liability & Indemnification

12.1 Limitation of Liability

Expedition Kilimanjaro organizes adventurous high-altitude expeditions with inherent risks. The organization works with certified guides, modern equipment and follows international safety standards, but cannot eliminate all risks of mountain activities.

12.2 Exclusion of Liability

Expedition Kilimanjaro accepts no liability for:

The participant participates at their own risk and is obliged to take out adequate travel insurance (article 4). All medical costs, evacuations and repatriations are at the participant's expense.

12.4 Indemnification

The participant indemnifies Expedition Kilimanjaro, its employees, partners and the local operator from all claims, damages and costs arising from:

For services for which the organization does not act directly as an intermediary, no liability rests with the organization. This concerns among others:

References to external websites and information sources are for information only. The organization is not responsible for the content, accuracy or availability of external websites.

12.7 Maximum Liability

Insofar as the organization would be held liable despite the exclusions in this article, liability is limited to the amount the participant paid for the expedition, with an absolute maximum of USD 5,000 per participant.

12.8 Liability Term

All claims against the organization must be submitted in writing within 3 months after termination of the expedition. After this period, any right to compensation expires.

13. Complaints & Disputes

13.1 On-Site Complaints Procedure

Complaints about the execution of the expedition must be reported immediately on-site to the lead guide or local operator, so that a solution can be sought directly where possible.

13.2 Written Complaints

Complaints that have not been adequately resolved on-site must be submitted in writing (by email) to Expedition Kilimanjaro within 14 days after the end of the expedition, stating:

The organization strives to respond to complaints within 30 days. If a complaint cannot be handled within this period, the participant will be informed with an indication of the expected handling time.

13.4 Emergency Situations

In emergency situations (medical, evacuation, accident), the participant must always first contact their own travel insurance. The organization and local operator provide assistance where possible, but do not act as financial guarantor.

13.5 Dispute Resolution

If a complaint does not lead to a satisfactory solution, parties may decide to submit the dispute to mediation. Parties each bear half of the mediation costs.

13.6 Legal Proceedings

Disputes that cannot be resolved amicably will be submitted to the High Court Arusha Registry in Tanzania, in accordance with article 1.3. This provision does not affect the right of EU consumers to turn to the competent court in their country of origin if EU consumer law permits this.

14. Privacy & Image Material

14.1 Data Processing

Expedition Kilimanjaro processes personal data of participants exclusively for the organization and execution of the expedition. For details, we refer to the Privacy Statement on www.expeditionkilimanjaro.com.

14.2 Collected Data

The organization collects:

Name, date of birth, passport number, medical information and dietary requirements are shared with the local operator in Tanzania for the safe and careful execution of the expedition.

14.4 Retention Period

Data is only retained for the duration of organizing the expedition and will be deleted within 3 months after the end of the expedition, unless legal retention obligations require otherwise.

14.5 Photos & Videos

During the expedition, photos and videos may be taken by guides and participants. Participation in the expedition implies that one may be captured in photos or videos.

14.6 Use for Marketing

If photos or videos showing participants are submitted to the organization, they may be used for marketing purposes on the website and social media, unless the participant objects in writing.

14.7 Right to Object

Participants have the right at all times to object to the use of image material in which they are recognizably visible. This objection must be submitted in writing by email.

15. Final Provisions

15.1 Amendment of Terms

Expedition Kilimanjaro reserves the right to amend these terms and conditions. Changes will be published on www.expeditionkilimanjaro.com and apply to all new bookings after the publication date. For bookings already made, the terms valid at the time of booking remain in effect.

15.2 Invalidity of Provisions

If any provision of these terms and conditions is declared void or voidable, the remaining provisions remain in full force. The invalid provision is deemed to have been replaced by a valid provision that aligns as closely as possible with the intention of the original provision.

15.3 Entire Agreement

These terms and conditions, together with the booking confirmation, constitute the entire agreement between Expedition Kilimanjaro and the participant. Previous agreements, commitments or correspondence that have not been confirmed in writing are not part of the agreement.

15.4 No Waiver of Rights

The fact that the organization does not invoke any provision of these terms at any time does not mean that the right to invoke this provision at a later time is waived.
